I'm working on a commercial project and need to use OSM data without its buildings features. I thus plan on using osmfilter to filter out the buildings. I intend to render the rest of the data, except with a different (personally/privately collected) buildings layer rendered as separate layer.

Does this constitute a derivative database? Am I required to release the proprietary, collected-from-scratch building features if I don't merge it with the OSM data stripped of its building features?
