I got an Chinese food take out place that has their menu and business card sitting at their desk ready to be taken but does that mean I can enter the data to OSM?

Well we don't do menus to start with, but in any case when in doubt the first place to ask if entering information in OSM is welcome is the establishment themselves, not here.

If you are restricting yourself to the basic, on public display, facts, there is no reason that you can't use them (but not if you are retrieving this information from a third party, google, yelp and so on).
