Simple scenario: a person creates a custom Google map][1] of all playgrounds in the area. The same person finds out about OSM. Can he/she use the KML export to move their work into OSM either by importing it into Potlatch/JOSM or by submitting to an importing tool/work group? When I say "can", I am primarily concerned with the technical side, although legal side is also relevant, of course. I assume that if a person created a map in the first place, the person is free to export/import that data as they see fit. Naturally, KML export/import has much broader applications and legal ramifications than the above example. Feel free to point me to relevant wiki, help or forum topics rather than rehashing what may have been argued. |

For GB an interesting source of KML's is this site, The guy who set it up as approached local government for the Definative Map ROWs in digital form. He as converted the info into KML form, unfortunaley some areas would not release the data, you could approach them, especailly if you have contacts,maybe. Its a great source for checking rights of way in England before and after surveying, but not for direct copying. http://www.rowmaps.com/ The KMLs can be display in several ways such as GPSPrune, Viking, Garmin Basecamp and Google Earth and more.. But as rights of way get changed, just like OSM it will always need updates.

Not necessarily. If you used Google Maps (or other map) to draw from, then your map is a derived work of Google Maps. In your case, though, if there is only a few playgrounds then maybe the person could just manually add them to OSM from memory? That might be faster and less error-prone than trying to import a KML. |
Nope. If "created" involved tracing points off Google mapping or satellite imagery (as seems likely in this case), it can't be used in OSM.
