I have noticed that someone had found a source of free for non-commercial use data. surely OSM will offend copyright if this data is used in OSM and if somebody then sells OSM data in another product

If you are sure they are using a source which is for non-commercial use only, then you are correct that it shouldn't be used for OSM. Perhaps worth reporting the user to the Data Working Group for them to investigate further.
