I found a navigation application based on OpenStreetMap data. The application is enriching OSM data with the companies own data to provide better navigation.

The company is promoting this on it's website. Also I wrote a mail to the developer support. They confirmed to me that they combine OSM data and their own data and use it for the navigation app.

Asking if that wouldn't mean it has to be published according to the ODbL I never recieved an answer. This made me a bit suspicious so I sent other mails to the company asking for the data in terms of ODbL. After a couple of weeks I still did not get any answer.

At least I'd wish to get an explanation why the company doesn't have to publish their data according to ODbL. But I never get an answer. What to do?

Is there a formal procedure to request the data to be published?

Do you mean skobbler who use OSM and enhance this? This question was also asked on Steve's blog with no answer: http://stevecoast.com/2014/05/19/why-openstreetmap-is-now-navigation-ready-for-people-like-you/

Yes I do mean Skobbler. I asked pretty much the same question as people did on Steve's blog. I got exactly the same answer: none. Have the feeling, that Skobblers policy is not to answer any ODbL related question in general. From my point of view ODbL is pretty clear in this case. (just the name "OSM+" sounds like being relevant to ODbL)

I would suggest either posting to the public legal-talk mailing list, or contacting the OpenStreetMap Foundation Legal Working Group for their advice.

While it is completly possible that the company in question is violating our licence terms, it just as well could not be, it really depends on the specifics. See http://wiki.osmfoundation.org/wiki/License/Community_Guidelines for some information on what is allowed.

Andy has already pointed out who to contact if you still believe that there are reasons for concern.

hm. I went through all the terms and from my point of view it is a pretty clear case. At least I'd like to have an answer to my emails saying something like "no sorry we don't publish our data because..." but there is simply no response at all as soon as it come to an ODbL related question. Other emails are answered very quickly though.

I better ask the question in the mailing list. Thanks
