Hello am new to the world of OSM and would like to check the following,

I have previously kept records of building locations in googlearth. These are personally created but i think would be of value to the wider community. I work as a consultant (mainly in developing countries) and one of the tasks i frequently undertake is to help companies understand their real estate portfolios, as such I map all the existing locations of their offices/retail stores etc.

If i can get these out of googleearth i could presumably import them to OSM so that anyone can use this resource. The question is how?

I own the data as i created it so don't see the argument that has been used in relation to other kml posts about copyright infringement

Please respect the answer of aseerel4c26 about possible copyright infrigement.

Also important is, that OSM is created by a community, so you should respect how they is working and what rules exist. For example "we" are very sceptical about fully automated imports:
http://wiki.openstreetmap.org/wiki/Automated_Edits_code_of_conduct

Thus I recommend you, to contact the local OSM community to ask them how to do a good merge with existing collected data and about possible pitfals. http://wiki.openstreetmap.org/wiki/Contact (you might try the local mailinglist or forum)

You can use an extension to import KML files into the JOSM editor:

hmm, iii, there is nothing said about "automated". In fact it rather sounds quite personal and careful, if you would ask me. Depending of the style and size of this "import" our import guidelines need to be respected, true.

Thats true. My intention was to make a point that 'converting and push to OSM DB' isn't what we understand as a good way to do imports.
Of course we are happy about everybody who likes to add data and help to keep it up to date :)

just a side note on the copyright thing: if you had drawn or positioned the buildings with the help of the google sat/aerial images in the background you are not the only "owner" of the data. You cannot import them to OSM then. See Legal FAQ on "google something".

Did you?

I think that answers the question then, so I would have to recreate all those marker points in OSM. fiddly.

@dominijk: Yes, sadly, I really think so. We are allowed to derive/trace from bing's aerial imagery (not their maps). So you could use them as background (default in our editors).

they aren't building traces just a point marker (not sufficient data to trace the buildings)

@dominijk: I am not fully sure, but I think also extracting single positions (what you did) could be protected by the rights owner of the aerial imagery which you used (at least the terms of service of google forbid it, if I remember correctly). Also see the second paragraph in the section in our FAQ (also linked in my last comment above); it is quite clear on "using"/"point marker".
