I have found a road tagged access=private but this is a bit misleading because

  • It is big enough to take road vehicles
  • Only the landowner's vehicles may use it
  • Any pedestrian may use it (don't know if permissive or right-of-way; distinction may not be meaningful in France)

How to tag it?

  • The size of the road does not have anything to say about the legal status of it and therefore the access=* tag.
  • The landowner should know the legal status of his roads, but you can use access=private if only the owner is allowed to use the road.
  • Depending on who can use it you can use motor_vehicle=no or access=no, foot=yes instead.

Take a look at the documentation for more info on how access tags work.
